Today, Tomasz Ludwik Krawczyk, partner at GKR Legal was interviewed for Fakty TVN on liability for damage cause by non-operating and deteriorating wind farms. Adv. Krawczyk presented option of disciplining the owners of farms in regards of care of their proper technical state.
He also referred to the causes of non-using of the wind turbines. The main reason seem to be a switch in the policy of the state and energy companies, resulting among other in refusal of acquisition of so-called green certificates and an attempt of nullifying of long-term purchase agreement concluded with investors.
